DUMPSTER DASH – TERMS & CONDITIONS

1. Introduction

1.1. Company Ownership
Dumpster Dash (“we,” “us,” or “our”) operates a hire service providing trailer skip bins (“Dumpsters” or “Skip bins”). By hiring or using any of our Dumpsters, you (“Hirer,” “Client,” or “you”) agree to these Terms & Conditions (“Terms” or “Agreement”).

1.2. Scope of Services
Dumpster Dash offers a rental service for Dumpsters, intended for lawful waste collection and disposal. No other use is permitted.

1.3. Acceptance of Terms
Please read these Terms carefully. If you do not agree to these Terms, you must not proceed with the hiring of a Dumpster.

2. Ownership

2.1. Hire Service Only
All Dumpsters provided by Dumpster Dash are for hire only. You do not, at any point, acquire ownership of the Dumpster.

2.2. Right to Possession
Dumpster Dash retains full legal title to the Dumpster at all times. You have the right to possess and use the Dumpster strictly for the agreed hire period.

2.3. No Transfer of Title
Under no circumstances is title to the Dumpster transferred or sold to the Hirer.

3. Booking and Hire Period

3.1. Booking Confirmation
A booking is only confirmed once we receive all required information from you and any applicable deposit or payment. We reserve the right to decline a booking without further explanation.

3.2. Hire Period

  • The hire period starts on the date of delivery or the agreed start date, whichever comes first, and concludes on the date scheduled for pick-up.
  • Extensions to the hire period must be requested in writing and may incur additional fees.


3.3. Collection

  • You must provide safe and clear access to the Dumpster for collection on the agreed date.
  • If our driver cannot access or retrieve the Dumpster, additional charges may apply.

4. Fees and Payment

4.1. Pricing
Our pricing depends on the Dumpster size, the type of waste, disposal fees, and the duration of hire.

4.2. Payment Terms
Payment must be made in full prior to or upon delivery unless otherwise arranged. Late or incomplete payments may result in cancellation or delayed service.

4.3. Additional Charges

  • Overfilling the Dumpster or placing prohibited items may result in extra charges.
  • Extended hire periods, damage to the Dumpster, or overweight loads may also trigger additional fees.

5. Usage Restrictions

5.1. Acceptable Waste
Only waste materials agreed upon in your booking are permitted in the Dumpster. You must follow local regulations on waste disposal.

5.2. Prohibited Materials & Asbestos Zero Tolerance

  • It is strictly forbidden to place any hazardous, toxic, or prohibited items in the Dumpster (e.g., asbestos, chemicals, batteries, flammable liquids).
  • We maintain a zero tolerance policy for asbestos in any load. If you are unsure about the material you are working with, do not put it in the Dumpster. Disposal of asbestos-contaminated waste is very costly, and asbestos-exclusive trailer skip bins are available upon special request.
  • Violation of these asbestos rules may lead to immediate termination of the hire and significant additional charges.


5.3. Safe Use and Loading

  • You are responsible for loading the Dumpster safely. The waste should not exceed the Dumpster’s capacity or protrude from the top. Overloaded or dangerously loaded Dumpsters create transportation hazards and may be refused collection.
  • Heavy, Dense Building Material: Please do not overload our trailer bins with heavy materials such as concrete, bricks, or soil beyond the stated weight limit. Transporting excessively overloaded bins is illegal and very dangerous.


5.4. Weight Limit

  • Our trailer skip bins have a weight load limit of 1.5 tonnes. Exceeding this limit can compromise braking and create a severe hazard on roads, streets, and highways.
  • If you are unsure of the weight of your rubbish, please contact us for guidance. Overloading may result in refusal of collection and/or additional fees.


5.5. Movement of Trailer

  • The Hirer must not move the trailer without prior permission from Dumpster Dash.
  • If the trailer is moved with or without authorisation and causes damage or rolls away from its position, Dumpster Dash will not be responsible for any resulting harm or liability.

6. Trailer Placement and Parking

6.1. Parking on Roads & Streets

  • Our trailers are registered and can be parked on roads and streets without a waste container permit (council permit). However, the Hirer must comply with any local street parking restrictions.
  • If a fine is issued for violating parking or signage restrictions, the Hirer will be fully responsible for payment.


6.2. Parking on Grass or Soft Soil

  • If the Hirer requests to place the trailer skip bin on grass or soft soil, the Hirer will bear any recovery costs if the tow vehicle cannot retrieve the bin (e.g., if it becomes bogged or stuck).
  • Our drivers will advise on potential concerns before proceeding with delivery.


6.3. Damage to Surfaces

  • Dumpster Dash is not liable for damage to driveways, lawns, or other surfaces caused by placement or retrieval of the Dumpster at the Hirer’s request.

7. Responsibility, Liability, and Indemnity

7.1. Hirer’s Duty of Care

  • The Hirer must exercise the highest degree of care while the trailer skip bin is in their possession.
  • Any damage other than normal wear and tear will be charged to the Hirer.

7.2. Client Liability

  • You are responsible for any damage to the Dumpster (beyond normal wear and tear) during the hire period.
  • You must ensure the placement location is safe and legally compliant.

7.3. Indemnification

  • You agree to indemnify and hold Dumpster Dash harmless against all claims, liabilities, and expenses (including legal fees) arising from your negligence, misuse of the Dumpster, or breach of these Terms.

7.4. Limitation of Liability

  • Dumpster Dash will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the hire of the Dumpster.
  • In no event shall Dumpster Dash’s total liability exceed the fees paid by you for the hire of the Dumpster.

8. Cancellation and Refunds

8.1. Cancellation Policy

  • If you cancel your booking within [2] days of the scheduled delivery date, a cancellation fee may apply.
  • Refunds (if any) are granted at Dumpster Dash’s discretion.


8.2. Failed Delivery or Collection

  • If delivery or collection fails for reasons beyond Dumpster Dash’s control (e.g., restricted access, hazards, or non-payment), additional fees may apply.

9. Termination

9.1. Breach of Terms
Dumpster Dash may terminate this Agreement immediately if you breach these Terms or engage in unauthorised or unlawful use of the Dumpster.

9.2. No Refunds on Early Termination
No refunds are offered if the Agreement is terminated due to your breach, misuse, or violation of these Terms.

10. Governing Law and Dispute Resolution

10.1. Governing Law
These Terms shall be governed by and construed according to the laws of [Your State/Country]. Any legal actions shall be exclusively filed in the courts of [Your State/Country].

10.2. Dispute Resolution
We encourage good-faith negotiation to resolve any disputes. If the matter cannot be resolved amicably, both parties agree to attempt mediation or another form of alternative dispute resolution before pursuing litigation.

11. Privacy Policy

Any personal information you provide to Dumpster Dash will be handled according to our Privacy Policy. By using our services, you consent to the collection and use of your personal information as described therein.

12. Revisions and Updates

Dumpster Dash reserves the right to modify or amend these Terms at any time. Any changes will be posted on our website. Continued use of our services after any revisions indicates your acceptance of the updated Terms.
